There will be a “3-month grace period” for container weighing, and the relevant provisions will be implemented without delay.

The Maritime Safety Committee of the International Maritime Organization has responded to the question of how the rules regarding the verification of container weights for exports should apply to containers already in transit before the relevant provisions take effect, stating that it agrees to allow a flexible period of three months; however, the implementation of these provisions should not be delayed in any way.

The Maritime Safety Committee of the International Maritime Organization has responded to the question of how containers already in transit before the entry into force of the provisions related to the verification of container weights for export should be governed, stating that it agrees to allow a flexible period of three months; however, the implementation of these provisions should not be delayed in any way.

There is widespread public concern about how the rules should apply to containers that have already been loaded and transported before this provision takes effect on July 1, 2016.

In February of this year, at a hearing held by the U.S. Federal Maritime Commission (FMC) on the “SOLAS Convention Amendment (New Regulations for Container Weight Verification),” several interest groups suggested that if the U.S. shipping industry was not ready, the amendment—scheduled to take effect on July 1, 2016—must be postponed.

At the 96th session of the Maritime Safety Committee, held from May 11 to May 20, a delegation proposed that, in the months following July 1, 2016, some flexibility should be allowed in the application of the new rules, in order to account for potential issues arising from software updates. These software programs are used to collect and transmit electronic data for verifying container weights, and such updates should not result in delays for containers that have already been loaded.

On this point, the Maritime Safety Committee concurred with the above-mentioned view and stated that the implementation of the new provisions of the SOLAS Convention should not be delayed in any way. It would be highly beneficial if maritime authorities and port-state control authorities could promptly adopt “effective and practical measures” within three months following July 1, 2016, to implement these provisions. This would help ensure that containers loaded before July 1, 2016, but transported on or after July 1, 2016, would not require weight verification upon arrival at their discharge ports, thereby providing a degree of flexibility. Within three months after July 1, 2016, if necessary, all parties involved in container transport should as soon as possible improve their procedures for recording, transmitting, and sharing electronic data related to container weight verification.
